CQC consultation response: the 8-week 2026 provider playbook

If you run compliance at a multi-site healthcare provider, the calendar on your desk has two deadlines that matter between now and the end of 2026. The first deadline, 12 June 2026 at 5pm, is the last moment your CQC consultation response can shape the framework you will be judged against. The second is implementation at the end of 2026, when the new frameworks go live and the work becomes internal readiness.

Eight weeks separate us from the first deadline. The second is eight months away. Both need a plan, and the first one expires.

Why the eight-week window matters more than it looks

The 11-week consultation period opened on 24 March 2026 and closes on 12 June 2026 at 5pm. Roughly eight weeks of that window remain. CQC published four draft sector-specific frameworks at the start of the period for adult social care, mental health, primary care and community services, and hospitals, secondary and specialist care.

The earlier "Better regulation, better care" consultation closed on 11 December 2025 with 1,703 responses. Against a sector the size of UK health and social care, fewer than two thousand individual submissions is modest. Each response carries unusual weight per reader. Around 95% of respondents agreed or strongly agreed with each proposed change to the assessment framework, and around 80% did the same on the inspection and rating methodology. The direction of travel is set; the detail is still live.

There is a second pressure running in parallel. CQC's 2025/26 business plan commits the regulator to 9,000 assessments by the end of September 2026. A material share of providers will be assessed under the current framework while the new one is being finalised. The consultation window is not a pause. It is a double window: shape the next framework, and keep current evidence ready for an inspection that could land this quarter.

A consultation response carries material influence without being a binding vote. CQC's initial response to the earlier round already shows how agreement levels have shaped published commitments. Sector-specific submissions carry more weight than silence and far more weight than passing a comment through an industry body alone.

The five-phase CQC consultation response playbook

Work splits into two halves. Phases 1 to 3 sit inside the eight-week window. Phases 4 and 5 run through to Q3 2026. Sequence matters because Phase 2 and 3 findings will sharpen a Phase 1 response.

Phase 1: Submit your CQC consultation response (before 12 June 2026, 5pm)

Use CQC's online response portal at cqc.govocal.com. The consultation landing page routes to all four draft documents.

Respond on the draft relevant to your provider type, plus the cross-cutting methodology questions on how assessments will be conducted, how ratings will be reached, and how evidence will be weighed. If you operate across sectors, respond on each draft that applies. Silence on a sector is read as absence of provider view on that sector.

Feed into the collective responses being prepared by Care England, the NHS Confederation, and NHS Providers. Provider-entity responses and collective responses both count; collective responses amplify themes, provider responses carry operational specificity. Do both.

#### Practical shape of a response

Identify the rating characteristics that are ambiguous, the KLOEs where your sector's operational reality diverges from the draft, and the evidence types that would be disproportionate to produce against the stated questions. Quote the draft language you are commenting on. Attach one anonymised example per point where you can.

Phase 2: Internal evidence audit (April to May 2026)

Inventory the evidence currently mapped to the 34 quality statements. Put it in one place. Tag each artefact by the key question it actually supports, the quality statement it was filed against, and the operational process that produces it.

Re-map to the five key questions: Safe, Effective, Caring, Responsive, Well-led. Park any artefact that existed only to serve the scoring mechanism. Flag duplication, where the same underlying evidence was re-cut and re-filed three different ways to satisfy three different quality statements.

The replacement structure is already visible in the published drafts. The adult social care draft carries 24 KLOEs across the five key questions (Safe 6, Effective 6, Caring 3, Responsive 4, Well-led 5). The shift from 34 quality statements to a smaller KLOE count per sector rewards fewer, better evidence artefacts against professional judgement. Large annotated binders will not score better than a clean evidence pack tied to the key questions.

This phase typically surfaces 30 to 50% duplication. That is where Credentially's 68% admin reduction lands in practice. Phase 3: Training review (May to June 2026)

Training completion is not competence. Draft rating characteristics across all four sectors are expected to lean harder into demonstrated competence than logged completion. A signed-off e-learning module evidences attendance. It does not evidence that the person can carry out the task safely under pressure.

Audit training records against NHS Employment Check Standards and Regulation 19. Six standards apply to every NHS appointment including temporary and unpaid: identity, right to work, professional registration and qualification, employment history and references, criminal record checks via the DBS, and occupational health assessment. These survive the framework change and sit underneath every Safe and Well-led KLOE on the new drafts.

The audit question for each clinical role: what evidence do you hold, beyond completion logs, that a named individual is competent against the tasks they are authorised to perform. Supervision notes, appraisal records, observed practice, and clinical audit outputs all count. Quiz scores and completion certificates on their own will not.

Phase 4: What to stop investing in

Three specific investments no longer pay their keep: scoring optimisation for evidence categories, thirty-four-way taxonomies built around the quality statements, and large annotated SAF binders. CQC has committed to removing numerical scoring from the assessment approach, with rating judgements made "holistically using professional judgement informed by evidence". Evidence libraries structured around the 34 quality statements need re-mapping, not expansion, and the scoring-era posture of showing everything in volume is the opposite of what the draft rating characteristics reward. A tight pack of well-chosen artefacts against each key question, with clear owners and current dates, will read better than a 200-page binder.

Anything built to game a scoring mechanism that no longer exists is sunk cost. Audit the evidence, archive what no longer serves the key questions, then redirect that capacity to Phase 5 commissioning.

Phase 5: What to commission now (live by Q3 2026)

Workforce compliance data pipelines. This is the operational backbone under the new framework. Expiry monitoring for every professional registration, DBS renewal, right-to-work re-check, and occupational health record. Automated verification against the GMC, NMC, and HCPC registers. DBS renewal tracking and right-to-work re-check schedules. A live record of the six NHS Employment Check Standards for every appointment.

Board reporting in the language of the new rating characteristics. Board packs that still speak in quality-statement scores will not help executives steer through the transition. Re-cut the compliance dashboard to report at key-question level, with the four rating descriptors (Outstanding, Good, Requires Improvement, Inadequate) against the draft characteristics published for consultation. Test it in a May board meeting, refine it by July.

Phase sequencing from April to end of 2026

Between 20 April and 12 June, Phases 1 to 3 run in parallel. The consultation response goes in. The evidence audit surfaces the artefacts worth keeping. The training review identifies the competence evidence gap. Findings from Phase 2 and 3 sharpen the Phase 1 submission.

Between June and the end of 2026, Phases 4 and 5 take over. The final framework publishes in summer 2026, pilots go live across the same window, and implementation lands by year-end. The 9,000-assessment operational backdrop keeps current-framework readiness in play throughout.

The providers who will be in the best shape at implementation are the ones who file a CQC consultation response with operational specificity, clear the scoring-era debt from their evidence libraries, shift training evaluation from completion to competence, and commission the workforce data pipeline that supports continuous readiness against any framework the final document lands on.
